Terms and Conditions

General conditions 

1.Smartcorals is engaged in Coral Breeding and sales all over EU countries.

2.These general terms and conditions apply to all behavior of Smartcorals, including in any case but not limited to offers from Smartcorals and agreements between Smartcorals and its customer. 

3.Deviations from the general terms and conditions are only valid if they have been expressly agreed in writing between Smartcorals and the Customer.

4.The applicability of any purchase and other conditions of the Customer is expressly rejected.

5.If and as soon as it has been established that one or more provisions in these general terms and conditions are invalid, void or legally voided, the other provisions of these terms and conditions will remain in full force and Smartcorals and the Customer will replace provisions with provisions that correspond as much as possible with the invalid, void or annulled provisions in terms of purpose and purport.

6. The failure at any time by Smartcorals to demand compliance with one or more provisions of the agreement, including the provisions in these general terms and conditions, does not in any way affect Smartcorals' rights to demand compliance by the Customer at a later date, to demand.

7.The general terms and conditions do not apply if and insofar as they are deviated from in the agreement between Smartcorals and the Customer.

General terms and conditions, conclusion and amendment of agreement

1.All offers made by Smartcorals to the Customer are without obligation, unless expressly stated otherwise in the offer.

2.An agreement is only concluded by written agreement between Smartcorals and its customer.

General terms and conditions, Prices and payment

1.All prices quoted by Smartcorals are including of VAT and other levies imposed by the government, unless expressly stated otherwise. Payments must be made according to the invoice made at checkout.    

2.The prices only apply to the goods mentioned by name in the invoice. 

3.Prices stated by Smartcorals are based on the purchase prices, taxes and the right deliverycharge applicable at the time of the invoice. If the customer is choosing wrong shipping charge not applicable to his or her order amount or location, Smartcorals is entitled to change the agreed price and the customer has to pay the outstanding amount in 14 days,delivery will be pending untill all invoices will be fully paid.

4.All invoices will be paid by the Customer in accordance with the agreed payment conditions stated on the invoice. In the absence of such conditions, the Customer must pay within 14 days of the invoice date.

5.If the Customer does not pay the amounts due within the agreed term, the Customer will be in default by operation of law and the Customer will owe statutory interest on the outstanding amount, without prejudice to its other obligations.

6.Costs of collection, both judicial and extrajudicial, are for the account of the Customer, with a minimum of € 250.00.

7.Payments made by the Customer always firstly serve to settle all interest and costs owed and secondly to settle due and payable invoices that have been outstanding the longest.

Reporting policy:

Take a clear picture of the dead or wrong coral in the original packiging and email the picture within 1 hour of delivery time to info@smartcorals.eu and state the article number of the coral you ordered,it can be found on the invoice.Some corals can get injured during delivery it does not mean it is dead,like a broken of sps branch or some injury on an lps,so in that case I'll provide advice how to speed up the heeling progress.In most of the cases injured corals recover fully.

Never throw away a coral without permission from Smartcorals. This will void the warranty.

Never send coral back without permission from Smartcorals. This will void the warranty.Expensieve corals classified by you dead in some cases may will need to be shipped back in a suitable packaging to Smartcorals when it is approved by Smartcorals,return shipping cost will be not refunded!

Without proof of the dead or wrong coral with an extra picture with date and time visible on the picture / please take a screenshot when the details are visible on the picture /, Smartcorals cannot provide credit.

Smartcorals will contact you within 10 working days for a warranty approval result.

If you have approved the warranty, I will contact you for a  solution or you will receive the credit on your account.

Shipping costs are not refunded uner no circumstances,including shipping or delivery carried out by Smartcorals or its delivery provider and return shipping paid by customer!

Gift frag is exluded under dead or wrong coral complaints.Gift frag will not be refunded or replaced nor credit granted in any circumstances.

Why only arrival guarantee?

I cannot guarantee the survival of coral in your aquarium. Your dipping and acclimating methods severly affects the corals health, I can not be hold responsible for that.
Light, current and water quality have a severe influence on the color and health of the coral, so that a coral can quickly change color or die.
You are responsible for maintaining the correct water values, which is important for the animals that live there.
Smartcorals therefore only guarantees the proper arrival of the right coral in the right condition.

Requirements for the warranty:

  • Address given was correct
  • The recipient was at home on the day of delivery
  • Email sent with photo of dead or wrong corals within 1 hours of arrival ,pictured in the original packiging, extra picture with picture details displayed date+time. (Photographs taken of the marine life not in original packiging, will not be accepted).
  • All photographs need to be clear and not distorted.  Photographs that do not clearly show their subject will be unable to be accepted as evidence. (Photographs taken of the marine life not in water, will not be accepted, as some marine life can look distorted/dead out of water).
  • Failure to be present to sign for your parcel on the first delivery attempt will void all claims.  Failure to follow Smartrcorals specified reporting procedure will also void any claims.

Return policy:

  • Return of live marine corals and any other live marine creatures is not accepted by SmartCorals under no circumstances.
  • Return of dry product in 20 days of dry product has been received by the customer. The dry product has to be sent back in the original packiging unopened in a resellable condition with details of original order. Refund of returned dry product will be granted after returned product has been received by Smartcorals and after inspection of dry products condition is in an acceptable level.SmartCorals has right to not grant refund of dry product if resellable conditions has not met, in this case pictures of dry product with clear explanation will be sent to the customer,if in any doubt please contact Smartcorals with a clear picture of the product before returning it.All transaction fees+other fees charged by your preferred payment method provider will be deducted from your refund amount. Return shipping and shipping will not be refunded under no circumstances.

Damaged or wet parcell:

You need to accept the damaged or wet parcell,but you have to make sure that the delivery companies representative files a report of the damaged or wet parcell. Reporting policy applies for the damaged or wet parcell. Please note that most corals survive the above parcell conditions but if you are in doubt do not hesitate to contact me.Failure to accept the damaged or wet parcell or failure to follow Reporting Policy will void warranty and refund will not be granted.

Cancalletion policy:

You can cancell your order 24 hours after of placing it. In case you have cancalled your order all transaction fees+other fees charged by your preferred payment method provider will be deducted from your order amount, those fees will be outlined on your refund invoice,the outstadnig order amount will be refunded in 14 days to your payment provider.

Online store software
My webshop has been developed with software from Webador. Personal data that you make available to me for the benefit of our services will be shared with this party. Webador has access to your data to provide me with (technical) support, they will never use your data for any other purpose. Webador is obliged to take appropriate security measures on the basis of the agreement I have concluded with them. These security measures consist of the application of SSL encryption and a strong password policy. Webador uses cookies to collect technical information regarding your use of the software, no personal data is collected and/or stored.

Web hosting
I purchase web hosting and e-mail services from Webador. Webador processes personal data on my behalf and does not use your data for its own purposes. However, this party can collect metadata about the use of the services. This is not personal data. Webador has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data.

Webador processes your name, address and residence details and your payment details such as your bank account or credit card number. Webador has taken appropriate technical and organizational measures to protect your personal data.Webador does not store your data longer than permitted by law.

 

General purpose of the processing

Shipping

Delivery to European Union only. Please see the list of EU Counrties with delivery prices in the shipping list. Delivery is by air with UPS 24 hours Express. Receving dates for the order: Tuesday,Wednesday and Thursday,no delivery on public holiday days.

 

Please do not order from countries not listed in the shipping list. In case you have ordered by mistake from countries not listed your order will be refunded other than transaction costs charged by your preffered paying method provider, unfortunately I can not refund those charges.

No shipping outside of European Union!

 

Delivery will be conducted for Co.Dublin,Co.Louth and Co.Meath. with a company car with the mutually agreed date and aprox time,you will need to be at home to receive your order. The corals will be in the packaging in less then 10 hours depends on your location,you will receive your corals in plastic bags,the insulated box will not be given to the customer as long as the delivery is carried out by the company car.

Every customer can buy their corals with confidence from Smartcorals.

All corals are hand selected and carefully maintained by myself.
When in doubt about the quality, the coral is immediately removed from the coralfarm.
When packing, each coral is checked again for quality and health.

Arrival guarantee:

Smartcorals guarantees that you always get the coral you ordered in the photo.
If it happens that a coral does not have the quality that I maintain when packing, I will contact you for a  solution that will certainly not dissapoint you.
In addition, I provide arrival guarantee.
This means that I guarantee that you will receive the ordered coral in a healthy condition.
If that is not the case, I will come up with a  solution.

FAQs

Coloration of corals will be different than on the picture under different lighting system or under different light system brands or under different light intensity and light spectrum setup.

Please make sure the coral you have orderd is suitable for your reef tank set up and habitat,icluding: light intensity,flow,water chemistry and current animals.

Please acclimate the corals properly to your reef tanks water and light.Inproper acclimatisation proccess will harm the coral and can cause injury or death.

Please note that dipping the coral at time of arrival can cause more harm than benefit in some cases.Dipping the coral for to long period or to high dipping chemical concentration will harm the coral and can cause injury or death.

Return policy

I started as a hobbyist few years ago,I was collecting every kinds and types of corals during that period from the most known EU websites and Irish shops, so I would like to take the oppoturnity and thank for all of them to allow me to reach the level to open my webshop. Most of the fraggable corals I aquacultured in my own farm. This webshop will be upgraded constantly to my customers and myself for easier use and accessibility. At the moment my delivery options and photographer equipments and skills are limited but I promise I'll improve those as time will pass and my business will grow.
